USING THE LIS PENDENS
REPORT
The Lis Pendens report lists out weekly foreclosure records that
have been filed at the courthouse. Typically, this is the first
document to be recorded at the courthouse to reflect that a foreclosure
suit has been started.
Foreclosure properties at this stage may be pursued, with the exception
of satisfying all outstanding lien holders. Lien holders are listed
within the comments section of Foreclosure/Disclosure Weekly for
easy identification.
Additionally, any other liens discovered through a title search,
must be satisfied - even if they were not mentioned in the foreclosure
suit.
Realize, each circumstance surrounding the owner's inability to
pay the mortgage may be different. Common examples include... a
death, loss of job, chronic sickness, etc. So each case may need
to be evaluated and approached in a unique manner.
A title search prior to making an offer is always necessary to
ensure that all lien holders have been accounted for, notified,
and served.
